Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and GO-OTE ("GO-OTE," "we," "us," or "our") governing your access to and use of the website, applications, content, and services offered under the GO-OTE brand (the "Services"). By accessing or using the Services, you affirm that you have read, understood, and agree to be bound by these Terms and by any policies referenced herein. If you do not agree, do not use the Services.
These Terms apply to all visitors, users, and others who access the Services. If you are using the Services on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.
Eligibility and Geographic Restrictions
You must be at least 18 years old and capable of entering into a binding contract to use the Services. The Services are intended for users located in the United States. We do not represent that the Services are appropriate or available in other jurisdictions; access from other locations is at your own initiative and risk, and you are responsible for compliance with local laws.
Educational Nature; No Medical or Pharmacy Services
GO-OTE provides educational information, comparative data, and resources related to pharmaceuticals, disease overviews, therapeutic equivalents, prices, side-effect profiles, and pharmacy comparisons. The content is provided for informational and educational purposes only and does not constitute medical, legal, or professional advice. Information is for educational purposes only and does not replace professional medical advice.
GO-OTE is not a healthcare provider, does not practice medicine or pharmacy, does not dispense or sell medications, and does not establish a doctor–patient or pharmacist–patient relationship. You must consult a licensed clinician for diagnosis, treatment decisions, and questions about medications and side effects. Never disregard professional medical advice or delay seeking it because of something you read on the Services. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately.
References to FDA- or EMA-approved products, therapeutic equivalents, or regulatory designations are for informational purposes only. Account Registration and Security
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information, to maintain and promptly update such information, to keep your credentials confidential, and to accept responsibility for all activities that occur under your account. You must notify us immediately of any suspected unauthorized use or security breach.
Permitted Use and Prohibited Activities
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.

If you submit feedback, ideas, or suggestions, you grant GO-OTE a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and exploit such feedback for any purpose without restriction.
User Submissions and Reviews
Where the Services permit reviews, comments, or other submissions ("User Content"), you represent and warrant that you have all necessary rights to submit such content and that your User Content does not violate law or the rights of others. You grant GO-OTE a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and improving the Services.
We may, but are not obligated to, monitor, moderate, or remove User Content at our discretion. We do not endorse or guarantee the accuracy of User Content.
Third-Party Services, Pharmacies, and Pricing
The Services may reference third-party pharmacies, telehealth providers, manufacturers, or other services, and may display pricing, availability, or coupon information. Such references are for convenience and informational purposes only and do not constitute endorsement or a recommendation. We are not a party to, and have no responsibility for, your interactions or transactions with third parties.

GO-OTE may receive compensation (including affiliate or referral fees) from third parties when you engage with their products or services through the Services. Such relationships do not influence our commitment to present information in an unbiased manner; however, you should independently evaluate offers and consult your clinician as appropriate.

We strive to provide accurate and up-to-date information, but we do not guarantee completeness, timeliness, or accuracy. Drug information, therapeutic equivalence, regulatory approvals, prices, and side-effect profiles may change without notice. You use the Services at your own risk.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GO-OTE, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO-OTE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO GO-OTE IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages; to that extent, the above limitations may not apply to you, but shall apply to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless GO-OTE and its owners, officers, employees, contractors, licensors, and agents from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms or applicable law; or (c) your infringement, misappropriation, or violation of any third-party right.
Communications and Electronic Notices
By using the Services, you consent to receive communications from us electronically, including emails, in-Service messages, and notices posted on the Services. You agree that all notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Privacy
Your use of the Services is subject to our privacy practices, which describe how we collect, use, and share information. We are not a “covered entity” or “business associate” under HIPAA and do not accept protected health information in a regulated capacity. Do not submit sensitive health information through unsecure channels.
Children’s Use
The Services are not directed to or intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, please contact us so we can take appropriate action.
DMCA Notice and Procedure
We respect intellectual property rights and will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Services infringes your copyright, please send a written notice including: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material; (d) your contact information; (e) a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Export and Sanctions Compliance
You represent and warrant that you are not located in, under the control of, or a national or resident of any country or person subject to U.S. embargoes, sanctions, or export restrictions. You agree to comply with all applicable export control and sanctions laws and regulations.
Governing Law and Venue
These Terms and any disputes arising out of or related to them or the Services are governed by the laws of the State of North Dakota, without regard to its conflict of law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods. Subject to the binding arbitration provision below, the state and federal courts located in Cass County, North Dakota shall have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts.
Binding Arbitration and Class Action Waiver
Agreement to Arbitrate
To the fullest extent permitted by law, you and GO-OTE agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, "Disputes") will be resolved by binding individual arbitration under the Federal Arbitration Act, rather than in court, except that either party may seek: (a) individual claims in small claims court within its jurisdictional limits; and (b) injunctive or other equitable relief in a court of competent jurisdiction for alleged infringement, misappropriation, or violation of intellectual property rights.
Arbitration Procedures
The arbitration shall be conducted by a single neutral arbitrator in English, seated in Cass County, North Dakota, and administered by a reputable arbitration provider applying its applicable rules for consumer disputes, as modified by this section. The arbitrator shall have exclusive authority to resolve all Disputes, including issues of arbitrability and enforceability, except as otherwise provided by law.
Class Action and Jury Trial Waiver
YOU AND GO-OTE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. YOU AND GO-OTE WAIVE ANY RIGHT TO A JURY TRIAL.
Opt-Out
You may opt out of this arbitration agreement within 30 days of your first use of the Services by sending a written notice of your decision to opt out to [email protected] with the subject line "Arbitration Opt-Out" and your full name and address. Your opt-out will not affect other terms.
Changes to the Services or Terms
We may modify or discontinue any part of the Services at any time without notice. We may update these Terms from time to time. When we do, we will revise the "Last Updated" date and may provide additional notice as appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms or applicable law. Upon termination, all provisions that by their nature should survive will survive, including ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution terms.
Force Majeure
We shall not be liable for any delay or failure in performance resulting from events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, Internet or utility failures, or other force majeure events.
Severability; Waiver; Assignment; Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of such right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction. These Terms constitute the entire agreement between you and GO-OTE regarding the Services and supersede all prior or contemporaneous agreements on the subject matter.
